The article analyses the Danish Act on protection of employees in case of transfer of undertakings, article 3(1), and the EU directive that lies behind the Danish provision. The article analyses the legal consequences in case of a termination of employment contrary to these Danish and EU provisions. It is tried whether such termination can be declared null and void, and against whom a demand for compensation from employees who have been dismissed contrary to the provisions can be directed.
