Description

In this article, the authors question whether the increased attention on the rule of law in social work, implies an actual strengthening of the citizen's legal rights. The efforts made by the legislature in form of introducing procedural rules to insure the rule of law, has to be held together with other factors, that influence the local administration of social benefit rights in practice. The article focuses on three elements, which has a tendency to weaken the rule of law: Economic considerations, the complexity of law and the lack of respect of the legal bond by the social workers in general. Especially the increased control with the municipality in recent years, through economic sanctions tied to the procedural rules, has had a significant effect on the application of law.
