Abstract

Danish practicing Licensed Surveyors are private operators with specific training and authorisation. The private Licensed Surveyor holds an exclusive right to determine the position of new and existing property boundary lines. In this capacity they play a key role in both the prevention of boundary disputes and in the resolution of boundary disputes.
Disputes are prevented by securing thorough documentation and acceptance from property owners when defining new boundaries. There are two methods of resolving boundary disputes – either by the simpler procedure called «skelafsætning» or by the more elaborate procedure called «skelforretning». «Skelforretning» is required procedure before any litigation over property boundary lines can begin.
In the majority of Danish boundary disputes the primary legal issue is the acknowledgement of prescriptive rights. As a result the main focus of the Licensed Surveyor is on any discrepancy between the actual situation in the field on one hand and the original agreements and official land surveys on the other. Any discrepancy must be investigated and clarified by the property owners before a ruling is made.
