Abstract
Supreme Court in judgement of 30 June 2023 ratified the use of § 24(1) of the Danish Environmental Protection Act as legal basis for ban on use, handling and storing of plant protection substances on terrain in safety zone for drinking water abstration. Municpal decisions on ban of use of pesticides was appealed to thr Danish Environment and Food Board of Appeal (DEFA) and further on to the Eastern High Court and the Supreme Court. The vulnerable geological and hydrogeological structure of the specific safety zone area, and the documented l risk of pesticides pollution justified the municipal ban, which was also not found disproportional by the Supreme Court
