Selling elastic by the meter requires good ethics: Legal ethics and Danish lawyers

In recent years Danish lawyers’ have faced several scandals concerning money laundering and tax evasion, which have actualized ethical discussions in the Danish Bar and Law Society (DBLS) about lawyers facilitating financial crime as ‘professional enablers’ versus their role as guardians of the rule of law and mediators of the common good. The DBLS has two main duties, namely to supervise ‘all lawyers in Denmark adhere to the legal and ethical rules and obligations of the legal profession and to safeguard the independence and integrity of lawyers’. However, the lawyers’ field in Denmark has been characterised by an increasing fragmentation and competition (Olesen & Hammerslev 2022; Hammerslev 2020). The many different types of lawyers and their specific roles and qualifications give rise to diverse and important issues of legal ethics and ethical questions. Despite little academic attention in Denmark, the DBLS has discussed lawyers’ ethics both through a renewed code of conduct and as lawyers’ role in ensuring societal ethical demands in a fragmented and competitive field. This paper explores how the framing of legal ethics has developed in debates within the DBLS. It is based on an original qualitative document analysis of issues of the DBLS’ trade magazine ‘The Lawyer’ [Advokaten] conducted for the period from 1976 to 2023. ‘The Lawyer’ is the only trade magazine to reach all lawyers while also addressing relevant stakeholders, journalists, etc. To strengthen the validity of the document analysis we interviewed Danish lawyers about l egal ethics. The paper fits into the volume’s part two on institutionalisation of legal ethics as it both examines the drivers behind the development of legal ethical framing and how the framing has developed.
